What Information Do We Collect About You and Why?

Information We Collect Directly From You. Certain areas and features of our Site and Services require registration. To register you may be required to provide your name, company, title, e-mail address, phone number, and a password you select as well as other information that Brocade may require from time to time. We also may collect additional information from you if, for instance, you create an account with us or one of our resellers, participate in contests or surveys, or submit a job application.
Information We Collect Automatically. We may automatically collect the following information about your use of our Site or Services through cookies, web beacons, and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and/or use our Services; and the URL or the webpage that led you to our Site. We may combine this information with other information that we have collected about you such as your user name. Brocade Users. Your user name and any information that you post to our Site, including, without limitation, reviews, comments, and text will be available to, and searchable by, all registered users.
Affiliates or Subsidiaries. Information we collect from you may be shared with our affiliates or subsidiaries.
Unaffiliated Third Parties. Certain information about you may be shared with select resellers and/or distributors, particularly if you or your company have purchased through a third party before.
Service Providers. Information we collect from you may be disclosed to third party vendors, service providers, contractors or agents who perform functions on our behalf.
Business Transfers. Information we have collected from you may be transferred to another company as part of a merger or acquisition by that company.
In Response to Legal Process. Information we collect from you may be disclosed in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
Aggregate and De-Identified Information. Aggregate or de-identified information about users may be shared with third parties for marketing, advertising, research or similar purposes.
Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the Third Party Ad Network section.
Cookies. Cookies are alphanumeric identifiers that are transferred to your computer’s hard drive through your web browsers for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Service. There are two types of cookies: session and persistent cookies.
Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you logged into the Site. Visitors to our Site who disable cookies will be able to browser certain areas of the Site, but some features may not function.
Clear GIFs, pixel tags and other technologies. Clear GIFS are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We and our third party service providers also use clear GIFs in e-mails to our customers, to help us measure e-mail response rates, identify when our e-mails are viewed, and determine whether our e-mails are forwarded.
How Do We Use Third-Party Ad Networks?
You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”).
Opting out of one or more NAI member or DAA member networks (many of which will be the same) means that those members no longer will deliver targeted content or ads to you. You may continue to receive advertisements, for example, based on the particular website that you are viewing. Also, if your browsers are configured to reject cookies when you change web browsers, your NAI or DAA opt-out may no longer be effective. You may be able to post content on our Site once you have created a user account, including your comments, pictures, and any other information that you would like to be available on our Site. Please note that if you post your own content on our Site or Services, your posting may become public in which case it is no longer governed by Brocade’s Privacy Statement.
What About Links to Other Websites?
Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Statement, but instead is governed by the privacy statements/policies of those third-party websites. We recommend that you check the privacy statements/policies of other sites you visit before providing any personal information.
How Do We Secure Your Personal Information?
We have implemented administrative, technical, and physical precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction and to help ensure it is used according to this Statement. Where personal data is processed by Service Providers on behalf of Brocade, we take steps to require those vendors to also comply with applicable data protection laws.
How Can You Access Your Personal Information?
You may modify personal information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time. In addition, EU (and other) residents may ask Brocade or any of its Service Providers to remove their personal information that is no longer necessary to perform requested services by sending a request to firstname.lastname@example.org.
What Choices Do You Have Regarding Use of Your Personal Information?
We may send periodically contact you via e-mail or telephone with promotional or other information. You may opt-out of such communications by following the opt-out instructions contained in the e-mail or by clicking on this unsubscribe link. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving recommendations or other information we think may interest you, we may still contact you about your account or any Services you have requested or received from us.
What About Children?
Our Site and Services are not designed for and do not knowingly collect and information from children under the age of 13. If we discover that a child under the age of 13 has provided us with personal information, we will delete such information from our systems.
What About California Consumers and non-US Visitors?
California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. If you reside outside the United States you should know that information collected under this Statement is hosted in the US and may be transmitted to other jurisdictions that provide a different level of privacy protection than your country. Also, information may be shared with Service Providers as appropriate to perform services.
How Are Transfers of Data Performed?
Brocade has adopted globally recognized privacy principles and only collects and/or shares that personal information which is necessary to conduct its business and perform requested services. Brocade and its controlled subsidiaries and affiliates in the United States and Service Providers comply with applicable legal requirements providing for adequate protection in the transfer of personal data to countries outside of the EEA and Switzerland.
